This page covers our terms of service for both our creators and customers.
The Terms are a legally binding contract between you, (the user) and Basically Gay Markets. It’s super important, so please read it carefully. We have to use our slightly longer name, because that’s what we are legally registered as, so for the sake of clarity in the rest of this document we will refer to Basically Gay Markets as “Basically Gay”.
This contract sets out your rights and responsibilities when you visit basically.gay use our site to make a purchase, sell an item or create a storefront, or any use other service or product we provide. (referred to as “Services” for the rest of this document)
By using any of our Services, you you’re agreeing to the Terms. If you don’t agree with the Terms you cannot use our Services. We also add a check box if you’ve read and agree to these Terms when you sign up. That’s basically how it works.
Your privacy means a lot to us, so please take some time to review our Privacy Policy.
Basically Gay is a commercial platform and you must be at least 18 years old to use our Services. If you are 13 or older, you may use an account managed by your parent or guardian with their permission and supervision.
Your Account
You do not need an account to browse on Basically Gay, but if you wish to make a purchase or start selling, an account is required. With great power comes great responsibility and we’ll cover those responsibilities below.
1) Be honest and accurate; creating an account with false or inaccurate information is prohibited on Basically Gay.
2) Keep it safe; your account is your responsibility; use a unique password and do not share this password or your account with anyone else.
3) Naming; If you decide to not have your legal name as the name associated with your account, that’s fine you can use other names for your account or your shop, however you may not use someone’s intellectual property rights, language that is offensive, hurtful, rude or otherwise violates the Terms.
4) You’re responsible for your account and its activity. You’re solely responsible for any activity on your Basically Gay account. If you’re sharing your account with other people, then the person whose financial information is on the account will ultimately be responsible for all activity. If you’re registering as a business entity, you personally guarantee that you have the authority to agree to the Terms on behalf of the business. Accounts are generally not transferable.
5) Protect your password. As we mentioned above, you’re solely responsible for any activity on your account, so it’s vital that you use a unique password, and keep it safe.
6) Our relationship between you and Basically Gay. These Terms don’t create any agency, partnership, joint venture, employment, or franchisee relationship between you and Basically Gay.
Your Content on Basically Gay
Content that you post using our Services is your content (for the rest of this document it’s “Your Content”). We don’t make any claim to it, which includes anything you post using our Services, such as shop names, profile pictures, listing photos, listing descriptions, reviews, comments, videos, usernames, and so on.
1) Responsibility for Your Content. You understand that you are solely responsible for Your Content. You represent that you have all necessary rights to all parts of Your Content and that you’re not infringing or violating any third party’s rights by posting it.
2) Permission to Use Your Content. By posting Your Content through our Services, you grant Basically Gay and, as authorized by Basically Gay in its sole discretion, third parties, a licence to use it. We don’t claim any ownership to Your Content, but we have your permission to use it to help Basically Gay function and grow. That way, we won’t infringe any rights you have with Your Content and we can help promote you, and your shop and its content. For example, you acknowledge and agree Basically Gay may offer you or buyers on Basically Gay promotions on the Site, from time to time, that may relate to your listings or other listings on Basically Gay.
Money and Basically Gay
When you make a sale on Basically Gay, we default to a 15% commission, meaning that the list price of your item -15% goes to you and is paid out monthly.
As a Vendor you are solely responsible for any tax burdens you may incur as a result of using our Services, we are a marketplace, not your accountant. We are not able to provide any tax advice.
